Most had predicted that Paramount, the parent company of CBS, would buckle under the pressure of Trump’s lawsuit. It baselessly claimed that the show 60 Minutes editorialized through editing when producing an interview segment with then-Presidential-Candidate Kamala Harris. It was Paramount‘s proposed merger with SkyDance Media, up for regulatory approval, that led many to conjecture that they would cave in and settle, just as ABC News did. Trump has been accused of ‘judge shopping’ and has been pushing for the case to be heard in Texas, ostensibly where a sympathetic judge resides. But also he is trying to leverage Texas state law that protects consumers against deceptive advertising and unfair competition. This is quite a stretch, for one, because no advertisement was involved, and furthermore, no involved parties were competing in a commercial sense. 60 Minutes and CBS rightly contend that their editorial judgements are protected by the 1st Amendment. Meanwhile they face an FCC probe, to which they made the extraordinary response of releasing all raw footage of the interview to the FCC. Presumably this was to offer exculpatory evidence.
